Terms of Service

  • Services. Subject to conditions in this Agreement, Trainer shall provide training and testing of Client's dog(s) for private lessons, virtual training, board and train, or day training services.

  • The private lessons offered by the Trainer are one hour long structured training at the Client's home or a public space. Sessions tailored to the specific needs and goals of the Client's dog(s). These sessions are designed to address obedience commands, behavior modification, and any other training objectives agreed upon by both parties. The Trainer will have sole discretion over the training methods and procedures employed, with the goal of achieving the agreed-upon training objectives by the end of the program.

  • The virtual training services provided by the Trainer offer one hour remote learning experience for the Client's dog(s) through video conferencing platforms. These sessions focus on theoretical training, behavior analysis, and guidance on implementing training techniques from a distance. The Trainer will have sole discretion over the training methods and procedures employed, with the goal of achieving the agreed-upon training objectives by the end of the program.

  • Equipment. Client agrees to purchase all necessary equipment for training before training.

    • Any exchanges, returns, or repairs for equipment will be done through the manufacturer's customary procedures.

    • Equipment can be purchased by the Client separately from the trainer or can be purchased from the trainer with advanced notice of 7 days.

  • Reservation and Cancellation Policy. Client must pay a non-refundable 25% deposit or pay in full upon scheduling training. Client is responsible for providing a minimum of 48 notice for location changes, cancelations, or reschedules.

    • The arrival window for training is 30 minutes before and 30 minutes after the scheduled appointment time. Failing to show up within 15 minutes of your trainer's arrival either virtually or in person will result in a forfeit of that meeting, no refund.

    • Client acknowledges that they must provide a location and address for training sessions 48 hours prior to the start of the appointment through the online scheduling portal. Failure to update the location and address will result in a forfiet of the lesson, no refund.

    • Private Lessons, Virtual Training, and Day Trains require 48 hours notice to reschedule or cancel. Failure to provide 48 hours notice or missing a scheduled meeting will result in a forfeit of that meeting, no refund.

    • If the Client needs to cancel their training package prior to starting training, they must make the request 48 hours prior to the start of their first scheduled appointment. If Client paid a deposit only, the deposit will be forfeited, no refunds. If the Client paid in full, the balance will be refunded minus 25% equal to a deposit and any fees.

    • Agreed upon start date can be moved one time, at the trainer's discretion, and is subject to availability.

    • Board and Trains require at least two weeks notice to move a start date and the start date can only be moved one time. Failing to give two weeks advanced notice for a board and train cancelation or reschedule, or failing to show up, will result in a forfeit of the entire amount paid to the trainer. No exceptions.

  • Liability. Subject to conditions in this Agreement, Trainer shall provide training and testing of Client's dog(s) for private lessons or virtual training services.

    • The trainer will have the sole discretion as to how such training and testing is to be performed under this Agreement.

    • Trainer shall not bear liability for any failure of the dog(s) to adhere to its training. The Client agrees to indemnify and hold Trainer harmless from any claims, liabilities, costs, and expenses, including reasonable attorney fees, arising from injuries or damage to the Trainer, the Client, other third parties, or their property due to the actions of the dog(s).

    • Although Client's dog(s) will be trained and tested under Trainer's customary procedures, Client acknowledges and agrees that Trainer makes no warranties or representations that the dog(s) will be able to perform or abide by its training successfully.

  • Results. All dogs have different temperaments and their owners vary in ability and willingness to follow the training program and therefore, the results will vary.

    • We require all homework to be documented in writing. This gives us the ability to adjust the training in each lesson so we can achieve your goals. Training logs are provided online and are the Clients responsibility to print out and bring written logs to training sessions. Clients may also log their work virtually but must send the log to the trainer via screenshot or other methods at least 12 hours prior to the scheduled appointment.

    • At the beginning of each session, Cleint will demonstrate the training skills learned by the dog. These skills shall include but are not limited to certain verbal commands and response to the proper use of training equipment.

    • If Client follows Trainer's instructions, logs their work, and at the conclusion of the training the dog fails to perform basic obedience, at the Client's option and trainer's decision, the Trainer will continue to work with the Client for a reduced rate to be determined by the Trainer either virtually or in-person.

  • Termination. The trainer may terminate this Agreement at any time.

    • The trainer may terminate this Agreement if the dog's or Client's behavior poses a risk to the safety of the Trainer, Client, any Third Party, or the Trainer's staff and all property of those parties. 

    • The trainer may terminate this Agreement if the Client does not follow all training procedures as determined by the trainer's sole discretion. 

    • The trainer may terminate this Agreement if the Client does not fully disclose previous history of their dog's behaviors including but not limited to training, aggression, resource guarding, jumping, unwanted behaviors, legal action, and action taken by their housing property.

    • If Trainer terminates the Agreement for any reason, no refund will be given. If the Client chooses to terminate the training for any reason, no refund will be given.

  • Dog Abandonment Clause. In the event that Client fails to pick up the dog within [10] days after the end of the boarding period or the scheduled pickup date, whichever is later, the dog will be considered abandoned. Dog(s) left past their training period will incur a fee of $100 a day per dog.

    • The trainer may take whatever actions are necessary to ensure the safety and well-being of the dog, including, but not limited to, placing the dog in a temporary or permanent home, or surrendering the dog to a local animal

    • Suppose Trainer takes possession of the dog due to abandonment by the Client. In that case, the Client will remain responsible for all fees and expenses incurred by the Trainer in connection with the care and housing of the dog, including boarding fees, veterinary expenses, and transportation costs.

    • Client acknowledges and agrees that this abandonment clause is necessary to protect the safety and well-being of the dog, and that Client will not hold Trainer responsible for any actions taken pursuant to this. 

  • Vaccines. A copy of Client's dog(s) current vaccination records (DHLPP, Rabies, and Bordatella) is required before training begins or must provided at any time requested by the trainer or third party.

  • Media. The client hereby consents to being recorded verbally, video, or photographed during training sessions for use at the sole discretion of the company.

  • Confidentiality. Trainer agrees to keep all information regarding the Client and the dog confidential, except as required by law.

  • Entire Agreement. This Agreement contains the entire agreement between the parties and supersedes all prior agreements and understandings, whether written or oral.

  • Governing Law. This Agreement shall be governed by and construed in
    accordance with the laws of the state of Pennsylvania.

    • This Agreement shall be binding on and insure to the benefit of the parties. No assignment or transfer of any interest in this Agreement whether voluntarily, by operation of law, or otherwise shall be allowed without the express written permission and consent of the other party. 

    • Any failure of either party to enforce, at any time or for any period of time, any of the provisions under this Agreement shall not be construed as a waiver of the trite of that party to enforce such provisions unless said waiver is in writing and signed by an authorized representative of by both

    • If any provision of this Agreement shall be deemed to be unlawful or unenforceable by a court of competent jurisdiction, such termination shall have no effect on the validity and enforceability of the other terms and conditions of this Agreement, and the challenged term shall be deemed

    • Trainers shall at all times be an independent contractor and shall not be deemed an employee or agent of the Client.

  • Acknowledgment. By signing below, Client acknowledges that Client has read and understood this Agreement and agrees to be bound by its terms and

    • I understand that my account must be paid in full prior to or at the time of handing your dog(s) over to the trainer or scheduled appointment.

    • I understand that failure to provide 48 hours notice for changing locations, cancelations, or reschedules will result in a forfeit of that lesson, no refund.

    • I understand the arrival window for training is 30 minutes before and 30 minutes after the scheduled appointment time. Failing to show up within 15 minutes of your trainer's arrival either virtually or in person will result in a forfeit of that meeting, no refund.

    • I understand that I must obtain all necessary training equipment recommended by the trainer before and during training.

    • I understand that I am responsible for the outcome of my dog.

    • I understand that following instructions as laid out by the Trainer will give me the optimum results.

    • I am responsible for reading any literature provided by Trainer online, in-person, during appointments, or between appointments for the training or any tools needed in training.

    • I realize that I have hired Trainer as a professional to determine which tools are needed to train my dog to my expectations.

    • I understand that Trainer does not limit the use of tools and can or will use tools including but not limited to slip leads, martingales, muzzles, fur savers, prong collars, harnesses of any kind, long leashes, short leashes, flat buckle collars, and e-collars. I agree to use these tools as the Trainer prescribed to achieve optimal results.

    • I understand that tools should not be left on overnight, when wet, or in the crate and I will read the instructions for such tools provided by the manufacturer. 

    • I understand that all dogs are trained by Trainer without liability on its part for loss or damage by or from disease, death, running away, theft, fire, or injury to persons, other dogs, or property by or to said dog(s), or other unavoidable causes.

    • I understand that Trainer is not liable for any damages caused by my dog during training, including without limitation, injury or damage to other dogs, persons, or property due to the aggressive behavior of my dog.

    • I hereby expressly agree to indemnify, defend, and hold harmless, Trainer or associates for any claim arising out of incident or my participation in the program, including without limitation the payment of attorney's fees and costs.

    • I understand that if my dog is aggressive, I agree to use a muzzle during the training sessions and as the trainer details. Trainer has trained aggressive dogs but there are no guarantees that aggression will disappear with training so it is the Clients responsibility to muzzle the dog and keep the dog out of potential problem situations at all times, not just during the training sessions.

    • I certify that my dog is in good health and has not been exposed to or exhibited symptoms of any contagious illness within the past 30 days. I understand that I may be required to pick my dog up from training, postpone training, or terminate training should he or she exhibit any signs of illness or injury.

    • If my dog(s) becomes ill, I understand that Trainer will attempt to notify me as soon as possible, but I give permission for Trainer to provide emergency medical treatment for my dog(s), should the need arise within the sole discretion and judgment of Trainer and such expenses shall be paid by me. doloribus asperiores repellat.
